1. About BidSwiss

BidSwiss is a secure, fully automated online auction platform that enables users to participate in timed auctions for various items. All auction processes, from bidding to payment collection, are automated and managed through our system.

2. Eligibility & Account Creation

By using BidSwiss, you confirm that:

  • You are at least 18 years of age
  • You are legally capable of entering into binding contracts
  • You will provide accurate, current, and complete information
  • You are not prohibited by law or regulation from using the platform
  • You have registered only one account per person or legal entity

3. Auction Rules & Process

General Auction Process

Auctions are conducted in a standardized format with transparent bidding, automated increments, and fixed time durations.

Bid Format & Requirements

Valid bids must meet the following criteria: (1) Bid amount must be higher than the current highest bid, (2) Bid must comply with minimum increment rules, (3) Bids are final once submitted and cannot be cancelled by the bidder.

Auction Duration

Auctions run for fixed durations: 1 minute, 3 minutes, 5 minutes, or 10 minutes. The timer is displayed in real-time. If a new bid is placed in the final seconds, the auction may be automatically extended to ensure fair competition.

Automatic Bid Relaunches

If no bids are received before the scheduled end time, the auction will automatically restart at the same reserve price. The platform will continue to relaunch until a valid bid is received or the auction is manually cancelled by the administrator.

Bid Anonymity

All bids are anonymized and displayed as "Offre #1", "Offre #2", etc. Bidder identities are not revealed to other participants during the auction. Only the auction winner and BidSwiss administrators know the winner's identity.

Automatic Auction Closure

Auctions close automatically when the timer expires and no further bids can be placed. The highest bidder at that moment is declared the winner.

Winner Determination

The auction winner is the user who placed the highest valid bid before the auction ended. In case of a tied bid (unlikely due to system precision), the earlier bid wins.

4. Payment Terms & Stripe Integration

Payment Requirement

All auction winners must complete payment to finalize their purchase. Winning an auction creates a binding obligation to pay.

Card Enrollment & Setup Intent

To participate in auctions, you must register a valid payment method (credit or debit card) with Stripe. We use Stripe's Setup Intent to authorize your card for future charges. This is a secure, PCI DSS Level 1 compliant process.

Pre-Authorization & Charging

By registering your card, you authorize BidSwiss and Stripe to charge your card for your auction winnings. Charges are processed automatically when you win an auction.

Payment Failure Handling

If your card is declined or payment fails, the following actions may occur: (1) Our system will attempt to re-process the payment, (2) You will be notified of the failed payment, (3) You will have a limited time to update your payment method, (4) If payment is not received, your account may be suspended or terminated.

Refunds & Disputes

All auction sales are final. Refunds are only issued at BidSwiss's sole discretion and in cases of legitimate errors, platform failures, or fraudulent activity. Disputes are resolved according to Stripe's policies.

Auction Fees & Charges

The final auction price is the amount you owe. Any additional platform fees or charges will be clearly disclosed before payment is processed.

5. User Responsibilities & Conduct

You agree to use BidSwiss responsibly and in compliance with all applicable laws. Prohibited conduct includes:

  • Attempting to manipulate auctions through shill bidding, collusion, or fraud
  • Using automated tools, bots, or scripts to bid automatically
  • Attempting to gain unauthorized access to the platform
  • Harassing, threatening, or abusing other users or staff
  • Providing false or misleading information in your account
  • Using the platform for illegal purposes or to facilitate illegal transactions
  • Interfering with the platform's operation or security

6. Disclaimers & Limitations

Service Provided "As Is"

BidSwiss is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the platform will be error-free, always available, or meet your specific needs.

Connection Loss & Bid Failures

BidSwiss is not responsible for failed bids, lost connections, or missed auctions due to internet connectivity issues, browser problems, or device malfunctions on your end. Maintain a stable internet connection during auctions.

Payment Processing Failures

While we use industry-standard payment processing (Stripe), we are not liable for payment failures, declined cards, authentication errors, or other issues arising from your bank, card issuer, or payment processor.

Data Loss & Backups

Although we maintain backups and security measures, BidSwiss is not liable for data loss, corruption, or loss of access to your account.

7. Administrator Rights & Auction Cancellation

BidSwiss reserves the right to:

  • Cancel, pause, or halt any auction for legitimate reasons (fraud detection, technical issues, legal requirements, etc.)
  • Refund all bids and restart an auction if issues are detected
  • Remove users who violate these terms
  • Suspend or terminate accounts engaged in fraudulent or prohibited behavior
  • Modify auction terms or platform rules with notice to users
  • Reject payments or refund charges if fraud is suspected

8. Limitation of Liability

To the maximum extent permitted by law, BidSwiss, its owners, employees, and affiliates are not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to: loss of profits, loss of data, lost auction opportunities, or payment disputes.

9. Intellectual Property

The BidSwiss name, logo, platform design, and all proprietary technology are the intellectual property of BidSwiss. Users may not reproduce, modify, or distribute any part of the platform without written permission.

10. Changes to Terms

We reserve the right to modify these terms at any time. Significant changes will be notified to users via email or by posting a notice on the platform. Your continued use of BidSwiss after changes constitutes acceptance of the updated terms.

11. Account Termination

BidSwiss may terminate your account at any time for violations of these terms, fraudulent activity, non-payment, or other legitimate business reasons. Upon termination, you lose the right to bid and access the platform.

12. Governing Law & Dispute Resolution

These terms are governed by the laws of Switzerland. Any disputes arising from your use of BidSwiss will be resolved through binding arbitration or legal proceedings in Swiss courts, as applicable.
